Questions asked by suppliers

Questions asked by suppliers
Supplier question Buyer answer
1. Will this role be subject to IR/35 Rules? In the event that IR35 changes do come into force after April 2017 they will apply to FCO Services ( FCOS ) and all off-payroll personnel ( contractors ) working through their own limited companies for roles at FCOS. The Digital Marketplace are using guidance from the below link:

https://www.gov.uk/government/publications/off-payroll-working-in-the-public-sector-reform-of-the-intermediaries-legislation-technical-note/off-payroll-working-in-the-public-sector-reform-of-the-intermediaries-legislation-technical-note

You may wish to seek similar clarifications/guidance that would relate to your situation should you be selected for this role.
2. If there is no obligation on the client to provide work and no obligation on the worker to accept work if offered; and the more commercial risk a contractor takes on the less likely the role will fall inside IR35. So can we assume that the notice periods, on both sides, will be 5 days or less? What is the minimum notice period to end the contract? The minimum notice period will be 5 days.
